Welcome to Moda Home Painting. These Terms and Conditions outline the rules and regulations for the use of our services. By hiring our services, you agree to comply with these terms. If you do not agree with any part of these terms, please refrain from using our services.

1. Definitions

Company: "Moda Home Painting," referred to as “we,” “our,” or “us.”
Client: Any individual or business entity entering into an agreement for services with Moda Home Painting.
Services: Painting services provided by Moda Home Painting, including but not limited to interior and exterior painting, touch-ups, consultations, and related services.

2. Scope of Services

Moda Home Painting agrees to perform professional painting services as described in the quote or contract agreed upon by both parties. Any additional services requested by the client may be subject to additional charges.

3. Quotations and Pricing

All quotations provided by Moda Home Painting are valid for 30 days unless otherwise stated.
The quotation includes a breakdown of the services and materials required. Any additional costs for unforeseen circumstances or changes requested by the client will be discussed and agreed upon in writing before proceeding.
A 50% deposit may be required before work commences, with the balance due upon completion.

4. Payment Terms

Payments must be made via cash, check, or credit card.
Payment is due upon receipt of the invoice unless otherwise agreed in writing.
In the event of late payments, Moda Home Painting reserves the right to charge interest at a rate of 1.5% per month on any outstanding balance.

5. Cancellation Policy

Clients may cancel or reschedule their appointment with a minimum of 48 hours' notice.
Cancellations made less than 48 hours before the scheduled service may result in a cancellation fee equivalent to 20% of the quoted service cost.
Moda Home Painting reserves the right to cancel or reschedule any service due to unforeseen circumstances such as weather conditions or other operational disruptions. In such cases, we will work with the client to reschedule at the earliest convenience.

6. Service Guarantee

Moda Home Painting guarantees that all services provided will be performed with reasonable skill and care. If any issues arise within 30 days of completion due to workmanship, we will address and correct the problem free of charge.

7. Client Responsibilities

The client is responsible for providing accurate information and ensuring that the work area is clear and accessible.
Clients are responsible for removing or securing any fragile, valuable, or personal items in the work area.
Moda Home Painting is not responsible for any damage to items not removed from the work area.

8. Limitations of Liability

Moda Home Painting will not be held liable for any indirect, incidental, or consequential damages arising from our services.
While we take all necessary precautions to protect the property, any damages caused by pre-existing conditions or structural issues will not be our responsibility.
Our liability for damages or losses related to the services shall be limited to the total amount paid by the client for the service in question.

9. Insurance

Moda Home Painting carries liability insurance to cover any damages or incidents that may occur during the provision of our services.

10. Termination

Either party may terminate the agreement at any time with written notice. If the client terminates the agreement, they may be subject to charges for work already performed or materials purchased.

11. Use of Subcontractors

Moda Home Painting may use subcontractors to perform services, but we ensure that they meet the same high standards of quality and professionalism.

12. Confidentiality and Privacy

We respect the privacy of our clients and are committed to protecting personal information. We will not disclose any client information to third parties except where required by law.
By using our services, you consent to the collection and use of your personal information for communication and service delivery purposes.

13. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Michigan. Any disputes arising out of these terms or our services will be resolved in the courts of Macomb, Michigan.
